Affidavit of Qualification for Michael H. Brennan

Before me, the undersigned authority, personally appeared, Michael H. Brennan, M.A., who upon being duly sworn deposes and says as follows:

1.  I, Michael Brennan, declare that I am over eighteen years of age, that I am sui

     juris and that I make this declaration from personal knowledge. If called to testify before that Court your affiant's testimony would be identical to the contents of this affidavit.

2. I am a Masters level Vocational Rehabilitation Counselor, who graduated from the University of South Florida in 1978. I have worked professionally in that capacity for 22 years. I worked as a Mental Health Counselor, licensed by the State of Florida from 1982 until 2001. I worked as a nationally Certified Rehabilitation Counselor from 10/1991-11/2001. I worked as a nationally Certified Case Manager since 1993-11/2001. I worked as a Rehabilitation Service Provider licensed in the State of Florida from 1989 to 1994. I am a Provider through Blue Cross Blue Shield of Florida since 1991. I worked as a Vocational Expert with the Social Security Administration since 1989. I had been a continuing education unit provider through the State of Florida Department of Insurance, Workers' Compensation Claims Professional in 1993.

5.  In May 2003 the Board of County Commissioners for Monroe County unanimously approved and hired Mr. Brennan as an ADA consultant for the Florida Keys Council for People with Disabilities for Monroe County to be used by the Disability Council.

6.  As the independent consultant and attorneys' expert on accessibility I assisted in the negotiation of specific ADA related access issues facilitating settlements for both private clients and through civil actions, totaling over 518 ADA cases, to date. These cases include:

Seven filed as class ACTIONS.  They are Publix, Amoco, 7-Eleven, Regal Cinemas, Texaco and Mobil & Muvico TheatersPublix, Amoco and 7-Eleven have accepted the class.

Amoco Oil, BP Exploration & Oil, and Atlantic Richfield as a result of the settlement will ultimately bring approximately 4000 stations and markets across the United States into compliance as a result of the class action Consent Decree. 

Publix Super Markets as a result of the settlement will improve disabled access at its 857 stores and pay up to $260,000 to settle a 7-year-old federal class-action lawsuit. Publix has up to six years to implement the terms of the settlement agreement, which the company's lawyers estimate will involve millions of dollars in remodeling. Brennan Consulting Inc. currently serves as Plaintiffs' Expert throughout the terms of the Consent Decree.

          Eighteen (18) cases have been Title II. All are settled.

Over the past 27 years, I have been actively involved in vocational rehabilitation counseling, psychotherapy, facilitator for numerous support groups, vocational expert, Workers' Compensation provider, case manager, and guest speaker for dozens of organizations.  I have authored more than 518 compliance assessments but other than being incorporated into settlement agreements or as Exhibits, am not published.  My work experience in counseling includes the following:

17. 3/79-12/82 Vocational Rehabilitation Counselor, Health & Rehabilitation Services, State of Florida Jackson Memorial Hospital Rehabilitation Center.  As the statewide coordinator, I arranged for the return of the severely handicapped to work and home.  In that capacity, I arranged for accessibility modifications in employment settings and at home.

18. 1981-1985 Association for the Advancement of the Mentally Handicapped. As case manager, and at one point acting Director, I had responsibility for program development for mentally handicapped adults progressing towards independent employment and lifestyles. Facilitated group counseling with clients and separate groups for parents.  Also included on-site visitation to clients at home and work.

19. 11/1985-12/1987 Miami Dade Community College, North Campus.  As the assistant administrator, and also acting administrator for a Demonstration Project for the Learning DisAbled, I instructed a class has an Adjunct Instructor.  In one class, I taught through sign language interpreters where more than 50% were hard of hearing or Deaf.  I worked through the Department of DisAbled Student Services, under a coordinator who is Blind.  My exposure to the hard of hearing, Deaf and visually impaired immensely enhanced my knowledge of access issues for those two disability groups.  While there, I also wrote and administered a grant funded through the college to evaluate the degree of ANSI compliance or lack thereof, regarding access at that North Campus.

20. 1989-1995, I worked has a Rehabilitation Provider and case manager of Workers' Compensation claims.  Again, this involved working with newly injured individuals and returning them to work at accessible sites.  At times, I dealt with access in both home and employment settings.  Responsibility for medical management and/or placement of clients with the goal of returning to work. Involved in all aspects of Workers' Compensation claims management. Approved Vocational Expert Social Security Administration, Office of Hearings and Appeals. (Over 380 cases)

21. 1984-10/2003, Brennan Counseling, Inc., 10/2003-Present Brennan Consulting Inc. Currently providing assessments of entities to determine the degree of compliance with the Americans for Disability Act, Florida Accessibility Building Codes, UFAS, FHA and ANSI regulations.  Providing expert testimony in both Federal and State courts.  Producing compliance assessment reports correlating the findings with applicable regulations and providing proposed remediations together with a cost analysis.  The reports correlate with digital pictures documenting the noncompliant components.  Authored more than 530 compliance assessments many incorporated into Settlement Agreements, Consent Decrees or attached as Exhibits.  Served as ADA expert/consultant in access in over 518 cases.  As owner/operator, all aspects of case management and expert testimony in worker's compensation and personal injury claims.  Provided Vocational Expert sworn testimony to the Social Security Administration, Office of Hearings and Appeals, in over 380 administrative hearings.  CRC #26296 10/91-9/01 and CCM #01187 10/91-9/01 licensed.  FEIN 03-0484502

1984-1997 Private practice counseling specializing in family therapy including adolescents and assisting the physically disabled in adjustment, coping, and living skills supervision.  I conducted private case management for the DisAbled who required supervision of their independent living as well as their interface with employers. The private practice also provided counseling and psychotherapy to troubled teenagers, stepparents and marriage counseling.  Other specialty areas include adjustments to divorce, step parenting, and counseling couples with marital difficulties.  Mental Health Counselor, State of Florida #0000237--1982-2001
