Public Acknowledgment of Expertise On Behalf Of Marc Dubin, Public Apology And Retraction of Statements  

Monday, December 28, 2009 In a regrettable lapse of judgment, I wrote false, misleading, and damaging information about Marc Dubin, Esq., Director of Advocacy at the Center for Independent Living of South Florida. In an e-mail, I expressed my dissatisfaction with a report published by the Governor's Commission on Disabilities. In the e-mail, I negligently and maliciously stated the following: “Are they all just idiots? Are they all just keeping their mouth shut because they are now big mucky mucky's appointed to these various boards and commissions? Have they no morals? Have they no accountability to their fellow members of the disabled community? I just can't believe what I read versus what I know it's a pathetic inexcusable situation throughout the capital, the administration and several of the appointees who are attorneys. Mark Dubin mdubin@pobox..com used to be an attorney with the DOJ before working with the Center for Independent living. How could he not know any of this shit? It just pisses me off!” I sincerely regret my behavior. It was highly irresponsible and unprofessional. Marc Dubin, in fact, has never been a member of the Governor's Commission on Disabilities. He had absolutely nothing to do with the writing of the report. His only involvement with the Governor's Commission On Disabilities was an effort on his part to educate the Commissioners about violations of the law he wanted them to address in the report. Marc had no authority over what was included in the report. I was wrong to imply or state otherwise. 

I know Marc Dubin to be an attorney with the highest level of integrity, and as a well-respected expert in the Americans with Disabilities Act. I know him to have been a Senior Trial Attorney at the United States Department of Justice, in the Disability Rights Section of the Civil Rights Division, where he was responsible for nationwide enforcement of the ADA on behalf of the United States. I also know him to have served on President Obama's National Disability Policy Committee, where he was responsible for providing advice about disability policy to then-candidate Obama, and I have the utmost respect for his integrity, professionalism, and expertise. I deeply regret my actions.
